Terms and Conditions of Sale and Return Horse1.online

All orders for products accepted by Horse1.online, an online shop owned and operated by Horse1 Equine S.L. CIF B82533282 with registered office at C/ Electricidad 56 Leganés 28918, Spain (hereinafter Horse1). They are accepted in accordance with the following General Terms and Conditions of Sale which will form part of the Sales Contract. Acceptance of orders will imply acceptance of these General Conditions of Sale.

  1. PRICES

The price of the products will be the price shown at all times in our online shop, except in the case of manifest error. Although we try to ensure that all prices shown on the site are correct, errors may occur. If we discover an error in the price of any of the products you have ordered, we will inform you as soon as possible and give you the option to reconfirm your order at the correct price or to cancel it. If we are unable to contact you, the order will be deemed cancelled and any monies paid will be refunded in full.

We shall not be obliged to supply you with any product at the incorrect lower price (even if our online shop has automatically sent you a Shipping Confirmation) if the price error is obvious and unmistakable and could reasonably have been recognised by you as the incorrect price.

The prices in the online shop are always inclusive of VAT.

For the Canary Islands, Ceuta and Melilla we do not accept orders through our online shop, but we can quote you an order by following the instructions on our website.

Prices are subject to change at any time but any changes will not affect orders already confirmed and paid for. HORSE1 will send customers the purchase invoice together with the products purchased.

  1. METHOD OF PAYMENT

Purchases of Horse1.online products and services can be paid online by credit card VISA, MASTERCARD or OTHERS, by credit card via telephone purchase (giving us the details of your card on the phone 916126502 exclusively), by bank transfer, by PAYPAL (in which case we will charge 1.95% of the total transaction for finance charges), or by any method of payment of those mentioned or in cash if the buyer chooses to collect the products in our physical shop.

In case of paying by credit card online or via telephone purchase, you must provide us with the following information:

Type of card.

Card number.

Expiry date.

Name and surname of the cardholder.

As an online electronic payment system, HORSE1 is a member of the REDSYS e-commerce payment gateway. All data provided for this purpose is encrypted under an appropriate protocol under the responsibility of REDSYS to guarantee maximum security. If payment is made by telephone, the card details that the purchaser passes to us by telephone are keyed into the virtual POS of Banco Santander or Bankia and the HORSE1 operator is responsible for destroying these details once they have been keyed into the virtual POS. HORSE1 does NOT retain this data or enter it anywhere else.

By clicking "Confirm Purchase" or by passing the details to us over the phone, you are confirming that the credit card is yours. Credit cards will be subject to checks and authorisations by the credit card issuer, but if the credit card issuer does not authorise payment, we will not be liable for any delay or non-delivery and will not be able to enter into any contract with you.

  1. PRODUCT AVAILABILITY

HORSE1 includes in its online shop products available in stock; in the event that any of them are not available for dispatch within 72 hours, HORSE1 will notify the buyer, informing him/her of the expected date of arrival and/or offering a similar product, and if the buyer does not accept, Horse1 will immediately refund the amount of the product.

  1. SHIPMENTS

D.1.- Orders will be sent by courier service. Our usual agencies ensure delivery within a period of no more than 5-7 working days from collection at HORSE1's premises for deliveries to mainland Spain and 7-10 calendar days maximum for deliveries to the Balearic Islands. In the event of occasional transport problems for reasons beyond our control, the customer will be informed.

D.2.- Orders placed on weekends and holidays will be shipped from the next working day.

HORSE1 needs a period of 24 hours (belonging to a working day) for the preparation of the order counted from the confirmation of the order in our systems.

D.4.- The prices of each shipment will be presented to the buyer in the shopping cart before the order is accepted and paid for.

F.- RETURN AND GUARANTEE.

F.1 Legal right to withdraw from the purchase.

Right of withdrawal: If you are contracting as a consumer and user, you have the right to withdraw from this contract within 14 calendar days without justification. The withdrawal period will expire 14 calendar days from the day on which you or a third party indicated by you, other than the carrier, acquired material possession of the goods or in the event that the goods making up your order are delivered separately. To exercise the right of withdrawal, you must notify Horse1Equine S.L. at the address C/ Electricidad 56 CP 28918 Leganés, or by e-mail to pedidos@Horse1.org . To meet the withdrawal period, it is sufficient that the communication concerning your exercise of this right is sent before the expiry of the withdrawal period.

F.2 Consequences of withdrawal.

In the event of withdrawal by you, we will reimburse to you all payments received from you, including delivery charges if any, without undue delay and in any event not later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to effect such reimbursement using the same means of payment used by you for the initial transaction. You will not incur any charges as a result of the refund. Notwithstanding the foregoing, we may withhold reimbursement until we have received the goods which are the subject of the withdrawal.

You must send us the goods that are the object of the withdrawal by courier service by calling us on our telephone number 91 612 6502, or by email:pedidos@Horse1.org or deliver them directly to our warehouse C/Electricidad 56 CP 28918 Leganés, without any undue delay and, in any case, within a maximum period of 14 calendar days from the date on which you inform us of your decision to withdraw from the contract. The deadline shall be deemed to have been met if you return the goods before this period has expired. Unless you return the goods to our physical shop, you shall bear the direct cost of returning the goods.

You will only be responsible for the diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods, and you must return the goods in perfect condition, with their bags or packaging unbroken and unopened.

F.3.- In the event that the shipment does not arrive in perfect condition or that there has been an error on the part of HORSE1, the customer will have the right to request that the product be resent at no additional cost on their part, once the product has been returned to our facilities and the incident has been verified. In the event that the shipment has been damaged during transport, the customer must note this on the agency's delivery note if possible, and inform HORSE1 of this situation by e-mail or telephone within 24 calendar hours of receipt, providing photographs. In this case, HORSE1 will indicate the procedure for making a complaint to the transport company in order to replace the damaged goods at no additional charge to the customer.

In the case of the return of defective products or products that do not correspond to your order, the cost of collection will be at our expense, these products must be in the same condition in which they were delivered and must retain their original labelling.

Provided that the customer has followed the above return process, HORSE1 will refund the price of the returned products plus shipping costs if any.

F.4.- If you wish to return a product purchased from HORSE1 you must first notify HORSE1 by e-mail to pedidos@Horse1.org or by fax to 91 612 5845 to Horse1 Equine S.L. indicating the following details:

Invoice number, date, name and email address with which the purchase was made.

Product to be returned, including price.

Reason for the return.

F.5.- Once your request has been analysed, you will be sent the necessary instructions for the return by email. Once received and verified that the product is in perfect condition, we will proceed to make the corresponding payment.

G.- REGISTRATION AND DATA PROTECTION.

In the case of natural persons, only those over the age of eighteen (18) may register with HORSE1. Registration with HORSE1 is, in all cases, necessary for the purchase of products and services. You can register by filling out the registration form.

The entire HORSE1 team is fully aware of the protection of your personal data and we respect the European Data Protection Regulation.

In compliance with the Organic Law LOPD and its Regulation -RD 1720/2007 and the RGPD applicable from May 25, 2018, we inform you that the data provided both in the registration of a new user, as in the sending of a contact form, will be incorporated into an automated data file created by, for and under the responsibility of HORSE1, in order to answer your queries and / or suggestions and to meet the commitments arising from the relationship that we can maintain with you.

The user has and may exercise their right to access, cancel, rectify, oppose and recover their data, as well as the right to be informed of the use of their data and Horse1 will also have to ask for your consent if it uses your data for any purpose not approved by you, as long as this purpose is not included in those exempted by law. The European Data Protection Regulation provides and clarifies the rights set out in the latest Spanish legislation. For this reason, we must keep at your disposal and clarify information about data protection measures at Horse1. We will also ask for your permission to process your data in some cases. In this way, we can offer you a service that is more tailored to your needs.

Horse1 may process your data without your consent only for certain mandatory purposes, e.g. to communicate a recommendation about a ration or a product you have ordered from us, to issue an official document or to deliver goods or to comply with legal regulations.

What happens if you do not want to consent to certain processing of your data?

You can let us know at any time that you only wish to receive communications directly related to your dealings with Horse1. The processing you have consented to is always accessible. You can change it at any time through your usual communication channels with Horse1; internet, telephone, email or in person at our office.

What measures has Horse1 taken to ensure the security of your data?

Horse1 has taken the following measures to ensure respect for data protection:

How do we obtain your data?

Horse1 obtains your details from the following sources:

Information you provide to us by email, or by filling in the form on our website: www.Horse1.online, or by telephone or Whatsapp or give us in person at the Horse1 offices.

Open sources of information such as newspapers and newsletters, telephone directories, lists of people belonging to schools or official organisations, social networks and the Internet.

Through companies that provide information on creditworthiness, delinquency and general financial risk indicators.

(The data we will process includes: identification data and data concerning your personal characteristics, e.g. type of discipline or breed of horse).

How long will we keep your data?

Your personal data will be blocked when they are no longer necessary for the purpose for which they were collected, remaining at the exclusive disposal of official legal entities, in particular the data protection authorities, for the attention of possible liabilities arising from the processing, during the period of limitation of these. Once this period has expired, Horse1 will proceed to the deletion of your data.

Who will receive your data?

Horse1 NEVER sells or gives your details to third parties except in the following cases:

- Transport agencies or courier service providers (in the case of the need for delivery of goods).

- Companies providing computer services to Horse1

- Competent Public Bodies, Tax Agency, Judges and Courts when Horse1 is legally obliged to provide them.

- Companies providing financial solvency services.

Use of Cookies:

Access to our website implies the use of cookies in order to recognise users who have registered and to be able to offer them a better and more personalised service as well as technical information.

Cookies do not allow access to personal data or, in general, to data on the hard disk.

Horse1 complies with the LOPD and RGPD 2024 (Directive 2002/58/EC).

When you first enter our website you are given the option to accept, reject or configure cookies, this authorization is valid for one year, however you can revoke your consent at any time by accessing your user data, clicking on the "My account" button at the top right of the website and then clicking on the option "Revoke my consent to cookies".

H.- LIMITATION OF LIABILITY

HORSE1 may host links to pages and sites of third parties. However, HORSE1 has no control over their content or external sources. Consequently, HORSE1 accepts no liability whatsoever for the content, advertising, goods and services marketed through them.

HORSE1 does not assume any responsibility for the inadequate functioning of its website if this is due to maintenance work, to incidents affecting national or international operators, to a defective configuration of the equipment of its customers and users or to its insufficient capacity to maintain the computer systems essential to be able to use our online shop Horse1.online.

I.- OBLIGATIONS AND LIABILITY OF CUSTOMERS AND USERS.

The user undertakes:

1.- Not to use Horse1.online to carry out or suggest activities prohibited by law.

2.-To refrain from engaging in any conduct that infringes the intellectual or industrial property rights of Horse1 or third parties, or that violates or transgresses the honour, personal or family privacy or the image of third parties, or that is unlawful or immoral.

3.- To refrain from carrying out any destruction, disablement or damage of data, programs or electronic documents belonging to Horse1 or any third party, as well as to introduce or disseminate on the network programs, viruses or, in general, any physical or electronic instrument or device that cause or are likely to cause any type of alteration in the network, in the system, or in the equipment of third parties.

4.- To refrain from carrying out any type of activity or practice that transgresses the principles of good conduct generally accepted among Network users.

5.- To inform us of any unlawful use of which you become aware. In any case, the user will hold Horse1 harmless against any claim, judicial or extrajudicial, which is presented to us as a result of the above actions or omissions. You are responsible for the security and use of your password, in which case we will be entitled to cancel your registration with Horse1.com, You will not reproduce, copy, sell or exploit in any way all or any part of the content and functionality of Horse1.com or use or access rights thereto. Any fraud or abuse committed within the framework of Horse1.online may be subject to administrative or judicial prosecution.

J.- ASSIGNMENT OF RIGHTS AND OBLIGATIONS

The contract is binding on both you and us, as well as our respective successors, assigns and successors in title.

You may not transfer, assign, encumber or otherwise transfer a contract or any of your rights or obligations under it without our prior written consent.

We may transfer, assign, charge, encumber, sub-contract or otherwise transfer a contract or any of our rights or obligations under it at any time during its term. For the avoidance of doubt, such assignments, transfers, assignments, encumbrances or other transfers will not affect any rights that you, as a consumer, may have at law or otherwise void, reduce or limit any warranties, whether express or implied, that we may have given to you.

K.- EVENTS BEYOND OUR CONTROL

We shall not be liable for any failure or delay in the performance of any of our obligations caused by events beyond our reasonable control ("Force Majeure Event").

Force Majeure Events shall include any act, event, failure to exercise, omission or accident beyond our reasonable control, including but not limited to the following:

  1. strikes, lockouts or other industrial action.
  2. Civil commotion, riot, invasion, terrorist threat or attack, war (whether declared or not) or threat or preparation for war.
  3. Fire, explosion, storm, flood, flood, earthquake, subsidence, epidemic or any other natural disaster.
  4. Impossibility of the use of trains, ships, aircraft, motor transport or other means of transport, public or private.
  5. Impossibility of using public or private telecommunication systems.
  6. Acts, decrees, legislation, regulations or restrictions of any government or public authority.

Obligations shall be deemed to be suspended for the period during which the Force Majeure Event continues, and we shall have an extension of time to perform such obligations for a period of time equal to the duration of the Force Majeure Event. We will use all reasonable endeavours to bring the Force Majeure Event to an end or to find a solution that will enable us to perform our obligations despite the Force Majeure Event.

APPLICABLE LAW AND JURISDICTION

The use of our online shop and contracts for the purchase of products through our online shop shall be governed by Spanish law.

Any dispute arising out of or in connection with the use of the online shop or such contracts shall be subject to the non-exclusive jurisdiction of the courts and tribunals of Madrid.

If you are contracting as a consumer, nothing in this clause shall affect your rights as a consumer under applicable law.
